Oakland Soft Story Retrofit Ordinance & Program

Oakland's Mandatory Soft Story Retrofit Ordinance, adopted on January 22, 2019, requires property owners to seismically strengthen buildings with large ground-floor openings, known as soft-story structures, to enhance earthquake resilience.

  • Construction Date: Built or permitted before January 1, 1991.

  • Dwelling Units: Contain five or more residential units (e.g., apartments, condominiums, hotels).

  • Vulnerable Lower Story: Feature a ground floor with large openings, such as multiple garage doors or expansive commercial storefronts, lacking sufficient structural support.

Compliance Deadlines

  • Tier 1-LB: Buildings with 20 or more dwelling units. Completion Deadline: February 21, 2023.

​

  • Tier 1-NR: Buildings whose owners failed to comply with the 2009 Soft Story Screening Program. Completion Deadline: February 21, 2023.

​

  • Tier 2: Buildings with 5 to 19 dwelling units. Completion Deadline: February 21, 2024.

​

  • Tier 3: Buildings where the soft story contains residential or commercial space. Completion Deadline: February 21, 2025.
